Zuma: Pray for peaceful polls

Johannesburg – President Jacob Zuma on Friday asked members of the Universal Church of the Kingdom of God to pray for peaceful elections on 7 May.

“Let us pray for peaceful and successful general elections on May 7, a right many sacrificed their lives fighting for,” he told thousands of congregants who welcomed him with thunderous applause and ululations when he entered the Ellis Park Stadium for their Good Friday service.

As he approached the stage those in the stadium sang “umshini wam'”, (bring me my machine gun), a song associated with Zuma.

He was accompanied by Gauteng premier Nomvula Mokonyane and Gauteng African National Congress chairperson Paul Mashatile.

Zuma said it was almost unthinkable that only a few years ago former president Nelson Mandela, Walter Sisulu, Oliver Tambo and many other ANC leaders did not have the right to vote.

“In their memory, let South Africans come out in their millions to vote on 7 May, in celebration of this hard won right to choose a government of our choice, the ANC.”

South Africans had a collective responsibility to fight crime, substance abuse and the abuse of women and children, Zuma said.

“Let us use this Easter period for a very profound reflection on how we are going to do all these, to improve our lives and our country…let the believers champion the course for good in the society, so that they lead the way.”

Before he delivered his speech, the church’s Brazilian Bishop Edir Macedo asked Zuma to sing his favourite song and he obliged with the Zulu “yinde lendlela esihambayo” (The road we are travelling is long).

The congregation sang it with him for at least three minutes and when he left with his bodyguards after his speech, a recording of the same song was played over the stadium’s sound system.-Sapa

Teen stabbed after spat over bus seat

Cape Town – A Western Cape school pupil was fatally stabbed while travelling to school on Thursday morning, provincial police said.
Police spokesperson Malcolm Pojie said 15-year-old Joseph Isaacs boarded a school bus at Jonkersberg to get to Groot Brak High School.

“Information reveals that the deceased and the suspect argued about a seat on the bus where after the suspect, 15, stabbed him with a knife in the chest,” he said.

The stabbed pupil got off the bus next to the R102.

He was later joined by his father, who accompanied an ambulance taking the boy to George Hospital.

“However, attempts to save him were unsuccessful and he died in hospital. An autopsy will be conducted on the deceased’s body to determine the exact cause of death.”

Pojie said a 15-year-old boy was arrested after being identified by witnesses.

He would be assessed by social workers later on Thursday and remained in custody at the Groot Brak River police station.

The teenager was due to appear in the Mossel Bay Magistrate’s Court on Tuesday.

Termination of Mdluli’s suspension set aside – SCA

Johannesburg – A high court ruling against the withdrawal of some charges against suspended police intelligence boss Richard Mdluli was upheld by the Supreme Court of Appeal (SCA) on Thursday.
The charges related to corruption and fraud, the SCA said in its ruling.

The SCA confirmed that the following executive decisions should be set aside:

The decision by the head of the Specialised Commercial Crime Unit of the National Prosecuting Authority, advocate Mrwebi to withdraw criminal charges of fraud and corruption against Lieutenant General Richard Mdluli the National Head of Crime Intelligence of the South African Police Services;

The decision by the national police commissioner to withdraw disciplinary proceedings against Mdluli;

The decision by the commissioner to terminate Mdluli’s suspension from office and to reinstate him in his position.

The SCA rejected one aspect of the high court order related to a murder charge. It did not confirm the setting aside of the following executive decision:

The decision by the Director of Public Prosecutions, South Gauteng, Advocate Chauke, to withdraw criminal charges of murder and seventeen related crimes – including kidnapping, intimidation and assault – against Mdluli.

Also, the SCA said it could not force the NPA to reinstate the charges without delay.

“The SCA did not confirm the high court’s orders to proceed with the criminal prosecution and the disciplinary proceedings without delay because, so the SCA held, this would constitute undue interference with the functions of the executive and a transgression of the separation of powers.”

Top pathologist hired by Pistorius won’t testify, report

Pretoria – A star pathologist hired by Oscar Pistorius told AFP on Thursday he will not testify at the athlete’s murder trial, another blow for his defence after a week of savage cross-examination.
Private forensic pathologist Reggie Perumal – who joined Pistorius’s hand-picked team soon after Reeva Steenkamp was killed on Valentine’s Day morning 2013 – will not take the stand, amid suggestions his post-mortem findings support key parts of the prosecution’s case.

Perumal has appeared in many high-profile cases in South Africa, where a private pathologist can cost upwards of R20 000 a day.

He was hired by Pistorius in time to attend the model’s autopsy.

When asked if he would testify, the Durban-based pathologist told AFP “no, ma’am”.

“I think you’re aware that I can’t say anything right now.”

Perumal’s absence from the witness box casts further doubt on the believability of Pistorius’s story, after a week which saw the Paralympian and one of his hired experts torn to shreds by prosecutor Gerrie Nel.

Nel drew a number of concessions during his cross-examination of Pistorius, who was at times argumentative, evasive and emotional on the witness stand.

On Thursday Nel hammered defence expert Roger Dixon, a forensic geologist who testified on key elements of the Pistorius crime scene, including the order of the bullets that hit Steenkamp.

Nel, a legal veteran known as the “Pit Bull”, derided the quality of the expert’s testimony, accusing him of “misleading” the court.

“I am not trying to mislead the court,” said Dixon.

‘Hired gun’

Perumal’s unusual decision not to testify has attracted the attention of his fellow forensic pathologists.

“I have heard that it might be because he refused to amend his version,” said Steve Naidoo, a Durban-based private forensic pathologist. “If so, and if Dr Perumal is not willing to twist the truth, then it’s to his tremendous credit.”

Naidoo, who said he has not talked directly to Perumal about the Pistorius case, said: “An expert forensic pathologist, independent or otherwise, must remember his function is firstly toward the court.”

If an expert tailors his version, then he risks ruining his credibility, said Naidoo, who worked as a pathologist for the State for 28 years before starting his private practise.

“That would be a hired gun approach,” said Naidoo, “and you’ve got to avoid that.”

‘In agreement’ at autopsy

Pistorius has pleaded not guilty to intentionally killing Steenkamp, saying he mistook her for an intruder in his upmarket Pretoria villa.

The State alleges Pistorius and Steenkamp were arguing and that the 27-year-old Olympian shot his girlfriend in a fit of rage.

Yet State pathologist Gert Saayman said vegetable matter in Steenkamp’s stomach suggested she ate around two hours prior to her death at 03:17, a finding that conflicts with Pistorius’s version of events that the couple were peacefully asleep at that time.

“To the best of my recollection he was in agreement,” said Saayman about Perumal.

“We must be, so to speak, on the same page before we leave the autopsy room,” he said. “We don’t have the opportunity to go back.”

Instead of Perumal, the defence called Jan Botha, a former State pathologist who has carried out approximately 25 000 autopsies.

Botha disputed Saayman’s conclusion, saying that determining the time of death through gastric emptying is guesswork, calling it a “highly controversial and inexact science”.

In an interview with local media last year, Perumal outlined his work philosophically, saying he is first and foremost a scientist.

“It doesn’t matter what the case is, if it is big or small,” he told the Mercury newspaper. “What is most rewarding is when the truth is presented and justice is done.”

Pistorius, whose legs were amputated below the knee after he was born without calf bones, gained worldwide fame for running on two carbon fibre blades at the Paralympics and 2012 London Olympics.

The trial has been adjourned until 5 May.

Oscar Pistorius trial TV channel takes two weeks break

Johannesburg – The Oscar Pistorius Trial Channel will take a break for two weeks, from next Monday to 5 May, spokesperson Michelle Esau said.

“The pop-up channel (DStv channel 199) will continue with repeats and an omnibus of the week’s court proceedings throughout the Easter weekend and stop on 21 April,” she said on Thursday.

The channel, broadcast from a studio in Johannesburg, has regular live crossings to the courtroom, sending out audio of the full trial and televising parts of it.

Pistorius shot dead his girlfriend Reeva Steenkamp, 29, on 14 February last year, through a locked bathroom door at his upmarket Pretoria East home. He says he mistook her for an intruder.

He has pleaded not guilty to a charge of murder, and to three charges of contravening the Firearms Control Act.

Pistorius, 27, whose legs were amputated below the knee when he was an infant, has achieved international fame as the “Blade Runner”.

He has excelled as a paralympian, running on two carbon-fibre blades, and competed against able-bodied athletes in the London 2012 Olympic Games.

The trial is set to resume in the High Court in Pretoria on 5 May.
