R300m security tender scandal rocks Rustenburg municipality


Opposition disapprove of Rustenburg ANC municipality’s deviation from tender specifications for security services

The EFF has called on the Hawks to investigate an almost R300 million Rustenburg local municipality security tender that has turned into a fierce legal battle between security companies.

EFF North West spokesperson Jerry Matebesi told City Press last week that the executive mayor, Mpho Khunou, and other managers at the municipality must be investigated for alleged corruption.

“If there was any wrongdoing, anyone who was involved must face the music,” Matebesi said.

The call by the EFF comes after Johannesburg-based security company Mabotwane Security Services obtained an urgent interdict from the Mafikeng High Court last month to stop a rival company appointed by the municipality from implementing the lucrative tender.

Mabotwane also wants the municipality to review the appointment of Ally’s Counter Force, based in Pretoria, arguing that its appointment was irregular and unlawful.

Mabotwane stated in court papers, which City Press has seen, that Ally’s was appointed despite failing to complete the MBD form (part of the document required for adjudication) and thus it was supposed to have been disqualified, as stipulated by the tender documents.

The interdict prevents Ally’s from rendering its services and allows the security companies that have been rendering services for the municipality to continue to do so, pending the outcome of the hearing, which will be held at a date to be decided.

“That the status quo in respect of the implementation of tender be maintained,” the court order says.

Documents in City Press’ possession confirm that the bid adjudication committee on the three-year contract security project recommended that Ally’s and Mabotwane be appointed last year.

Furthermore, the bid evaluation committee recommended that a legal opinion be sought on the recommendation to appoint two security companies, while the tender documents stipulated that only one successful company was supposed to have been appointed.

The technical report on security service providers shows that Mabotwane emerged number one after scoring 10 out of 10 points during the evaluation process.

Hwibidu Security Services emerged as runner-up after scoring six. Ally’s was third on the list after scoring only five points.

The report states that the technical evaluation team could not verify whether Ally’s was firearm-compliant and the address of their offices was not verified as they had not signed a lease agreement during site visits by the bid committee.

“The technical evaluation team was shown the firearm strongroom but could not gain access inside. The team could not verify whether the company was accredited for firearms, but was only told by the company CEO [chief executive officer] that they were accredited and had 90 firearms belonging to the company,” the report says.

Mabotwane was appointed but, despite scoring the highest points, was only required to provide 62 guards in less risky areas for just under R700 000 per month for three years.

However, Ally’s was required to provide the remaining staggering number of guards in other areas, including high risk ones, for over R8 million per month for the same period.

The tender required the successful company to provide a total of 518 guards for the municipality.

This move has left municipal insiders baffled. They said that they didn’t understand the rationale behind the municipality’s decision to deviate from the initial tender specifications.

However, Ally’s lawyer Mandla Tshabalala said that, according to the answering affidavit from the municipality, his client was not at “fault”.

“In our answering affidavit, we gave evidence that we complied. According to the municipality, the reason for wanting to review [the tender] was that they were not supposed to issue the tender to two companies,” he said.

Hwibidu managing director Walter Rachidi said the security company was considering taking legal action against the municipality.

“Our legal team has requested information from the municipality. How do you give a tender to a company which scored the lowest?” asked Rachidi.

He said the municipality must concede it made a mistake.

“This is a very stupid mistake. My advice to the municipality is that they must do the right thing and award the tender to the right company. We are not going to accept re-advertisement of the tender. We are going to challenge it,” he said.

Mabotwane declined to comment.

Municipal spokesperson David Magae refused to say more than: “The municipality, respecting the rule of law and its independence, will not make any further comment in line with the sub judice principle, until the matter has been finalised.”

The EFF’s Matebesi slammed the ANC-run municipality, describing the tender scandal as an attempt to raise funds for the ANC ahead of general elections in May.

He said the EFF would be joining progressive forces on the ground and in courts of law to get to the bottom of the cancer of corruption in the province.

DA North West premier candidate Joe McGluwa said the party raised the issue of the security tender at the recent portfolio committee meeting.

“We warned against the allocation of the security tender after it went to court.

“The DA is not surprised by what has happened as far as the adjudication of the tender is concerned,” he said.

Witrand Psychiatric Hospital CEO under siege

North West MEC for Health, Madoda Sambatha has appointed a task team to investigate concerns raised by employees at Witrand Psychiatric Hospital in Potchefstroom.

This comes after a meeting between Sambatha and representative of employees at the hospital in an effort to end protests that affected delivery of health services at the hospital.

The employees at the hospital call for the removal of the hospital’s Chief Executive Officer (CEO), and management to stop with harassment and intimidation of employees.

However, Sambatha said: “The department is pleased to announce that the protest action has been called off, employees have returned to work and mental health services restored.

“The hospital is rendering a critical service to vulnerable members of society and cannot afford disruption of health services. We will continue to engage with employees and management of the hospital to find a lasting solution.”

Sambatha is expected to return to the hospital on Monday.

BREAKING: Gordhan demands apology from ANC after party says he ‘attacked’ black engineers

Public Enterprises Minister Pravin Gordhan is demanding an apology from the ANC and the retraction of a statement the party issued on Wednesday.

According to the ANC’s statement, Gordhan and Senzo Mchunu, both allies of President Cyril Ramaphosa, launched attacks on black professionals.

The party says in the statement it distances itself from Gordhan and Mchunu and that it will seek to engage with them.

But in a letter addressed to Ace Magashule on Thursday, Gordhan says he rejects the ANC’s statement and that he finds it “extremely offensive”.

“I want to state emphatically that I have not made any statements diminishing the status of black engineers,” Gordhan’s letter reads.

He adds: “It would appear that some individuals at Luthuli House give more credence to the orchestrated utterances of individuals like Matshela Koko who has done so much damage at Eskom. Accordingly, I must insist on a retraction and an apology from the ANC spokesperson.”

The ANC’s statement was issued under the names of Zizi Kodwa and Dakota Legoete, the party’s acting spokespersons.

Another spokesperson, who did not want to be named, told News24 that Gordhan and Mchunu blamed “black professionals” for the dire situation that the parastatal was in.

Neither Kodwa or Legoete answered their phones when called for comment.

Six houses belonging to police officers torched in Bloemhof

The North West Provincial Commissioner, Lieutenant General Baile Motswenyane condemned acts of violence that erupted in Bloemhof on Wednesday night.

North West police spokesperson, Captain Sam Tselanyane said it is alleged that an unconfirmed number of Boitumelong Township residents went to the police station and demanded the release of five suspects who were arrested for assault.

He said the protesters allegedly pelted the police station with stones, but were eventually dispersed.

“A police officer sustained facial injuries after being hit with a stone during the confrontation with protesters, while damages were also caused to the police station.

“It was later reported that during the night, three houses belonging to police officers were torched and damaged.  Of the three houses, one burnt to ashes and the furniture was extensively damaged at the second house, while only a curtain was burnt at the third one,” Tselanyane said.

He further said on Thursday, protesters gathered again in Bloemhof apparently with the intention of attacking the police station. Tselanyane added that the protesters dispersed back to Boitumelong Township after being addressed by the Cluster Commander of Pudimoe who will also be meeting with the community in the afternoon.

“The Provincial Commissioner sternly warned members of the community to respect the rule of law and to refrain from destruction of private and state properties such as police stations, vehicles and houses as that can have detrimental effect to lives and service delivery to the community.

“She raised a concern about attacks on the police who are there to maintain law and order including protection of those who protest. “The police will not tolerate any act of public violence and drastic action will be taken against anyone who commits crime,” said the Provincial Commissioner.”

He said although the situation is currently under control in the area, the police will maintain their presence.  Tselanyane said motorists and other users of the N12 road are requested to be vigilant while driving between Christiana and Bloemhof.

Meanwhile, the Police and Prisons Civil Rights Union (POPCRU) spokesperson, Richard Mamabolo said they have noted with concern the civil unrest taking place in Bloemhof.

Mamabolo said: “It is understood that this altercation is on the basis of this group of people taking the law into their hands by assaulting people they believe committed crimes in the area, clearly demonstrating that these perpetrators have not been willing to work with police in combating criminal activities.

“We appeal to community members not to take the law into their hands, condemn these unjust acts and want to call for calm and dialogue in the community of Bloemhof.”

He expressed that it is only through good working relations between police and communities that they can make communities a better place to live in, and no amount of attacks against each other can bring about any peaceful resolutions.

“We call upon the SAPS, community leaders and the relevant government officials to speedily attend to this regrettable eventuality which should never find expression in our neighbourhoods,” said Mamabolo.

Ramaphosa was part of Zuma’s failed tenure – Holomisa


President Cyril Ramaphosa should not be judged as a stand-alone entity, and his character should be tested on the basis of the role he has and continues to play within the ANC, a party that is being shown to have been captured and one that led the country to the brink of calamity.

This is what United Democratic Movement (UDM) president Bantu Holomisa said as his party launched its provincial and national election manifesto at the Isaac Wolfson Stadium in Port Elizabeth yesterday.

Holomisa said it was disingenuous for Ramaphosa to appeal to South Africans to “trust him despite his party’s failings”.

“Why? Because he knows that his party – the ANC – is not worthy of your trust. We all know what damage it has done – be it to our economy, our safety, our education and health systems, and so the list goes on.

“How can the ANC be trusted when it stood meekly by as Jacob Zuma and his cronies looted the state and stole your taxes and deprived you of economic opportunity?” he asked.

The UDM leader was in part challenging how Ramaphosa seems to be attempting to reinvent himself as an anticorruption candidate who South Africans “should trust” and send to do their bidding for them.

Holomisa argued that Ramaphosa served under the same Zuma whose tenure he now seeks to distance himself from.

“Today we hear noises from the ANC that the past nine years were disastrous under the Zuma administration. Yet the current crew is made up of the very people who said that he did nothing wrong. They even invented a slogan that read: ‘We have a good story to tell,’” said Holomisa.

This was met by a round of applause from the scores of supporters who filled the stadium.

“I ask the question again: Can we trust them given that the same organisation was at pains to defend Zuma and was hellbent on discrediting the Public Protector and the judiciary?”

He said that, even if it was the case that “President Ramaphosa may be a decent man”, he was just one individual out of many in a party that had been exposed at the Zondo commission of inquiry into state capture as having been party to corruption and fraud.

Holomisa also argued that, given the disunity currently plaguing the party, should the ANC be voted back into power on May 8, there was no guarantee that it would appoint Ramaphosa as its president.

“HOW CAN THE ANC BE TRUSTED WHEN IT STOOD MEEKLY BY AS JACOB ZUMA AND HIS CRONIES LOOTED THE STATE AND STOLE YOUR TAXES AND DEPRIVED YOU OF ECONOMIC OPPORTUNITY?

“There is nothing stopping the ANC from deciding to remove Ramaphosa – just as they recalled Thabo Mbeki and replaced him with a person who is now facing more than 800 criminal charges,” said Holomisa.

He called on citizens to no longer place their trust in the ANC as it had “lost touch with ordinary South Africans”.

He said that the UDM pledged to improve the country’s healthcare system, particularly in terms of infrastructure and maintenance.

“Hygiene at many clinics is at unacceptable levels and must be addressed immediately. It remains a sad fact that many South Africans must travel huge distances to the nearest clinic or hospital. Health infrastructure and services need to be provided closer to the poor,” said Holomisa.

In light of the tragedy at Driehoek High School in Vanderbijlpark, where four pupils died after a concrete slab collapsed on them, the UDM also pledged to prioritise the building, fixing and upgrading of school infrastructure.

Holomisa also said his party would “establish a permanent commission on education, whose primary responsibilities will be to establish and build upon basic educational policy pillars, as well as ensure that there was stability in the curriculum to give our pupils the best opportunity to succeed in their studies”.

He also revealed that his party would reopen teacher training colleges and impose national standards for teachers to ensure that they had the necessary resources to provide the highest level of professionalism possible.

On unemployment, Holomisa said his party would launch a massive initiative focusing on job creation through infrastructure maintenance and development.

Taung-born politician sworn-in as MPL

The former ANC North West Provincial Executive Committee (PEC) member, Mmoloki Cwaile was sworn-in as the new Member of Provincial Legislature (MPL) in the North West on Tuesday.

The outspoken Cwaile was at the forefront during #SupraMustFall campaign. The North West Provincial Legislature Speaker, Sussana Dantjie welcomed Cwaile from the ANC.

“Cwaile was sworn-in as Member of the Provincial Legislature (MPL) in the vacant seat left by the late Ndleleni Duma who recently passed on after long illness. Schedule Act 73 of 1988 schedule 1a Section 23(1)(b) states that in the event of a vacancy in the legislature to which this schedule applies, the party which the vacating member represented must fill the vacancy by nominating a person.

“In accordance with Section 107 of the Constitution of the Republic of South Africa, Cwaile took an oath and affirmed faithfulness to the Republic and obedience to the Constitution before he could begin to perform his duties in the Legislature,” Dantjie said.

Police seized stolen vehicle, illegal firearm

Two suspects aged 22 and 44 briefly appeared at the Stilfontein Magistrate’s Court on Monday for being in possession of gold concentrate. The North West police spokesperson, Col Adele Myburgh said the arrest emanated from a multi-disciplinary stabilisation operation that was conducted in Khuma Location in Klerksdorp on Thursday.

Myburgh said the suspects will remain in custody until their next court appearance on the 10th of January 2019.

“During the operation, 1 ton of crude gold were seized after being found in possession of the accused. An abandoned transformer as well as a Volkswagen Amarok was also seized by police. Further investigation revealed that the recovered vehicle was stolen in September this year in Germiston.

“During another stabilisation operation on Friday, Sineth Themba Dywili (30) was arrested for being in possession of illegal firearm and ammunition. Dywili was arrested in Kanana Location near Orkney,” Myburgh said.

She said the suspect was remanded in custody until Tuesday next week. Myburgh said also dangerous weapons such as knives were also seized during the operation.

She said the multi-disciplinary operations will continue also as part of the Safer Festive Season Operations to ensure that perpetrators are brought to book.

Gupta-linked head of department reinstated

The arbitration court has ordered the North West Department of Health to reinstate its embattled HOD Dr Thabo Lekalakala after he was placed on a special leave pending an investigation into claims of corruption.

Lekalakala was suspended in April . His suspension lapsed in June and then he was placed on special leave as he was accused of benefiting from the Gupta linked Mediosa company.

He is expected to be back at work on Monday.

Health department’s spokesman Tebogo Lekgethwane  welcomed the arbitration verdict made  by  the Public Health and Social Development Sectoral Bargaining Council in November 8.

Lekalakala’s alleged involvement in the Mediosa contract  saw the provincial health department workers  protesting and calling for his removal.

They refused to be led by a person linked with spending millions of rands on a mobile clinic rather than using that money to pay for their bonuses.

Lekgethwane  said Lekalakala was suspended following allegations of procurement irregularities which affected a number of contracts which have since been a matter of forensic investigation.

“One such contract is that of Mediosa which has since been terminated,” Lekgethwane said.

He said there were two issues which were to be considered in this matter. The suspension of Lekalakala and the disciplinary actions instituted against him.

Lekalakala was suspended and returned to work a day after his suspension lapsed, and then he was placed on special leave.

He said Lekalakala was suspended with full salary, however, owing to the fact that allegations against him were still being investigated, he was afforded special leave.

He said the arbitration verdict which instructs health department to reinstate Lekalakala  was only concerned with the merits of special leave.

“The verdict has nothing to do with the investigations and the disciplinary actions.

“ The Department can confirm that disciplinary actions are continuing,” Lekgethwane said.

Lekalakala has been charged with procurement irregularities and misrepresentation of facts.

Specifically on the special leave matter, Lekgethwane said his department was still studying the verdict and applying its mind as to the way-forward.

Efforts to get a comment from Lekalakala were unsuccessful.

EFF boss ‘threatened to cut up female colleague’s genitalia’

EFF’s deputy chairperson in North West province boasted that his children were well educated as compared to the party’s administrator whom he called “rubbish”.

This was heard in  the Mmabatho magistrate’s court in Mahikeng on Tuesday, when EFF leader Bungas Ntsangane appeared on a case of assault.

who is also the party’s chief whip is facing a charge of assault and intimidation.

Ntsangane, who is also the party’s chief whip in the provincial legislature, is accused of beating up junior staff member Maggie Klaas in November 2017. The assault allegedly started after Ntsangani had requested Klaas to report early to work so that she could  open the office for assets management officials.

Klaas allegedly told him that she would not be able to come early to work as she did not have the office keys where the assets staffs were supposed to work.

Called to testify on what he had observed on that day, a witness who is also a party member, Thapelo Mothibi, said he heard Ntsangane verbally abusing Klaas.

“He said he did not care if he won’t be elected at the coming elections, saying he has children who were lawyers and engineers and that he did not care about rubbish like Maggie,” he told the court.

He said he also heard Ntsangane threatening to cut up Klaas’ genitalia, and also hearing a reference to her clitoris being “up” because the party was preparing for then  upcoming 2017 December conference.

Earlier in the day, another witness and EFF’s provincial chairperson Betty Diale, told the court that Ntsangane throttled Klaas and punched her with fists.

She said the incident might had happened for less than a minute, contrary to the version of Mothibi who said it happened for three to four minutes.

Ntsangane’s legal representative advocate Modisaotsile Segopolo capitalised on the contradiction and said all the witness gave the court different version of what had happened on that day, especially on how the said assault happened.

“You agree with me when I say, you saw what you saw but that contradicts what other witnesses have testified,” Segopolo asked.

The court heard that Ntsangane and Klaas wrestled for a while as Ntsangane was feeling that Klaas who was reporting to him at the time was being disrespectful and undermining his authority.

He pleaded not guilty, saying Klaas was instead the one who attacked him and that he pushed her away as she was trying to strangle him. The trial continues on Wednesday.

Police ready to battle cancer

The Roodepan police held a cancer awareness campaign. Northern Cape police spokesperson, Capt Thabo Litabe said the aim of the initiative was to create awareness on all issues surrounding breast cancer.

Litabe said the event forms part of the build-up activities to the main event on October 31. He said members of the South African Police Service (SAPS) from various provincial offices in the Northern Cape in conjunction with the Women’s Network and Men for Change will host a Pink Walk to generate funds for CANSA.

“The Pink Walk is the brainchild of SAPS Corporate Communication at the provincial offices. The event will start at Kimberley Police Station at 8:30am and will end at Trimm Park in Kimberley. Members of the SAPS Sports Office from Provincial Human Resource Development will from thereon host a mass aerobic session and a registration fee of R10 will be requested from each participant.

“Components and stations will also be expected to donate cupcakes and tea that will be sold at the event. All proceeds generated on the day will be handed over to CANSA at the event. The initiative at Roodepan Police Station was spearheaded by Captain Aubrey Mgadi, Sergeant Eloise Kock, Administration Clerk Elmarie Yalias and Provision Administration Clerk Kelebogile Leeuw,” he said.

In remembrance to those who lost the battle to cancer, members lit candles and observed a moment of silence to honour the deceased.
Litabe said they have also invited the Cancer Association of South Africa (CANSA) to the event. He said the members had serious talks about the disease. CANSA representative, Leone Taljaard also gave a lecture on how to identify cancer symptoms at an early stage.
