Malema woes worsen as Sars pounced in

Image

The list of possible legal problems for Julius Malema is growing, with reports that the SA Revenue Service (SARS) has already obtained a tax sentence against him for alleged non-payment of R16-million in taxes due.

Rapport newspaper quotes SARS spokesperson Adrian Lackay as saying they obtained the tax sentence after exhausting all possible avenues to secure payment. He told the newspaper the amount included unpaid taxes, penalties and interest.

The expelled ANC youth leader is also expected to face charges of fraud, corruption and money laundering, following a Hawks investigation.

Trade union Solidarity earlier laid charges of incitement to violence against Malema, after he urged workers to make mines ‘ungovernable’.

According the City Press, Malema did not oppose the application by SARS.

It is also reported SARS was about to seize Malema’s property and assets in Gauteng and Limpopo.

Alan Lewis, a tax law consultant and advocate, told City Press the judgment showed two things: Malema had a “hell of a lot of money” and he was in deep trouble.

It is also reported Sars was about to seize Malema’s property and assets in Gauteng and Limpopo

Lewis, a former SARS employee, said the revenue service would most likely hand the judgment to a sheriff of the court, who would attach Malema’s properties and assets.

SARS started looking into Malema’s tax affairs last year after it was revealed that he was linked to companies which had obtained lucrative contracts from the Limpopo provincial government.

Millions of rands were channelled through Malema’s Ratanang Family Trust, according to the report.

Malema’s expected to hand himself over to police and appear in court in Polokwane on Wednesday. – Additional reporting by Sapa.

BY Obakeng Maje

Johannesburg- Moroka Swallows won the MTN Top 8 after walloping Supersport at Orlando stadium, near Soweto.

The game  started like a house on fire as both teams asked each other lots of questions. Supersport showed no respect to Swallows as they launched attack in the early minutes of the game.

Supersport midfield,Doutie became a thorn on Swallows flesh. He set on Franklin Cale in the opening minutes who made no mistake with and unleashed a long range with his first touch that left Graig Etafia sprawling on the ground.

“We missed so many opportunities and if you do not take your chances, you get punished. So credit to Swallows and welldone” said distraughted Supersport coach.

Even though Gavin Hunt did not say much, you could see disappointment written all over his face.

Swallows regrouped after Nergadze equalised for the Dube Birds when he hit a long range shot from deflected shot.

Supersport launched more attack while the game progress and was guided under a chattering eye of Moroka Swallows defence.

Both teams showcase the enterprising football and played with virgo.

Ashrif Hendricks received yellow card after bringing Doutie down just outside the 18 yards.

“We played as a team and we were very unfortunate to concede an early goal” said Zeca Marques.

The referee decisions came under spotlight when he denied Swallows what seems a penalty after Fransman blocked a ball in his penalty area, but waved “play on”.

Swallows came with gun blazing and were unlucky when Lerato “All you need is love” Chabangu shot was cleared off the goal line by Diouf.

Swallows second goal came after they bit an offside trap and Bennett Chanene chip the ball over buyoed Fernadez.

Swallows breathe a sigh of relief after the referee blew his whistle and make them 2012 MTN TOP 8 reigning champions after almost three decade without winning the elusive Top 8.

Malema arrest orchestrated by cowards: Magaqa

Image

Expelled ANC Youth League secretary general Sindiso Magaqa on Saturday told the M&G that the imminent arrest of Julius Malema is “part of an orchestrated campaign, by those who lack the political coherence to engage on political issues, to tarnish the image of the [ANC Youth League] president.”

Magaqa said that Malema and his associates had been expecting the arrest.

“They resort to dirty tricks because they’re cowards,” he said.

“It was not a surprise for us because we knew there is an orchestrated campaign that is being run in government to arrest the president of the ANC youth league,” he said.

“You will have noticed that after the Marikana issue, this thing of arrest has popped out because people were very aggrieved that [Malema] emerged as a leader who can go and listen to the people, and people have responded to his call for a mining revolution so we can share the economy of this country,” said Magaqa.

“We knew when we touched the nerves of the institution in power now, of the establishment, they were bound to respond.”

Magaqa said the threat of arrest had not cowed Malema. “These actions by the government give us more strength. We are more determined,” he said.

“The youth of South Africa will rebel,” he said. “We are ready to fight fire with fire.”

Magaqa said neither he nor Malema had seen the charges but added that “whatever charges come we will go to the court”. In the meanwhile, it was business as usual.

Plundering the state

On the other side of the coin, civil rights organisation, AfriForum, that laid a charge of corruption with the South African Police Service (SAPS) against Julius Malema on 24 July 2012, has welcomed the news that a warrant has been issued for the arrest of Malema on these charges.

Kallie Kriel, CEO of AfriForum, congratulated the Hawks, as well as AfriForum’s own investigation unit, on the professional way in which they conducted their respective investigations against Malema, resulting in this warrant being issued.

AfriForum’s charge against Malema was made in terms of the Prevention and Combating of Corrupt Activities Act (Act 12 of 2004) and laid at the Brooklyn Police Station in Pretoria.  This charge concerned the fact that Malema allegedly used the Ratanang Family Trust, of which he is the sole trustee, as a vehicle for obtaining compensation from business people in exchange for his assistance to ensure that government tenders were granted to them.

According to Kriel, the issuing of the warrant sends a very clear message to all leaders that no-one is above the law.  “Malema made a serious error in judgement by thinking that he is untouchable,” Kriel said.

Kriel stated that the fact that someone like Malema, who claims to represent the poor, according to the findings of the investigations against him, in fact helped to plunder the state coffers to enrich himself at the cost of service delivery to the poor, is a disgrace.

Hotshot lawyer

On Friday the City Press newspaper reported that Malema’s lawyer, Nicqui Galaktiou confirmed that an arrest warrant has been issued for him.

The paper reported that Malema faced charges of money laundering, corruption and fraud relating to his Ratanang Family Trust and its shareholding in On-Point Engineering, a company that allegedly made millions from Limpopo government tenders.

The Star newspaper has revealed that Galaktiou had previously and successfully defended among others Gijima, SA business person Robert Gumede and former Zambian president Rupiah Banda’s son, Henry Banda.

She is a director at Brian Kahn Incorporated Attorneys.

She has 12-years experience in motion and trial work and disputing resolution matters and is head of the Commercial Litigation and Dispute Resolution Department.

Galaktiou is also a member of the International Bar Association.

Malema was expected to appear in a Polokwane court next week after a warrant was issued for his arrest. – Sapa.

Amajita draw with Nigeria

Image

By Obakeng Maje

Nelpruit-The South African Under 20 National Team, Amajita played to a one all (1-1) draw against Nigeria in their first leg of the African Youth Championship qualifiers.

The clash took place on Friday, 21 September 2012 at the Mbombela Stadium in Nelspruit, Mpumalanga.

Amajita’s Thabani Mthembu continued his unbelievable run with yet another goal in the 12th minute to give South Africa the lead going into half time.

But reigning champions, Nigeria, came back into the second half with more aggression and intent. Their efforts paid off in the 54th minute when Ajagun Abduliellel scored from a corner kick after the South Africans failed to clear the ball.

Amajita coach Solly Luvhengo says although he is not happy with the result, he was a bit disappointed that his side had conceded at home.

“I am happy with the team’s performance but obviously not happy with the result. It is not the end of the road as I believe we still have a fighting chance in Nigeria in the second leg. I believe we could have scored more goals but luck was not on our side. We have noted where we went wrong and it is back to the drawing board to work on those mistakes,” said Luvhengo.

Amajita travel to Nigeria for the second leg which is scheduled to take place in a fortnight.

Malema could be charged for incitement: Expert

Image

Johannesburg – Expelled ANC Youth League leader Julius Malema could be found guilty of inciting mineworkers to violence, regardless of whether he influenced them, an expert has found.

Former University of South Africa criminal law lecturer Carel Snyman concluded that Malema, who is due to appear in court in Polokwane next week on unrelated charges, did not have a valid defence to the charges of incitement.

Snyman was commissioned by trade union Solidarity to compile an expert view on the matter.

The union earlier filed criminal charges of incitement to violence and intimidation against Malema, following comments he made to striking mine workers urging them to make the mines “ungovernable”.

Solidarity deputy general secretary Dirk Hermann said on Friday that Snyman had found Malema did not have a valid defence.

“It is… immaterial whether or not the mine workers had in any way been influenced by Malema’s utterances,” he said in a statement.

“Incitement to commit any crime is punishable. The definition of incitement does not distinguish between successful and unsuccessful incitement.”

Hermann said the report had been given to the Hawks to assist in their investigation of the charges against Malema.

Earlier, an arrest warrant had been issued for Malema.

“We were notified today that a warrant of arrest was issued for Mr Malema,” his lawyer Nicqui Galaktiou told Sapa.

“We don’t know which court and when it will happen, but we are engaging with authorities on that. It will be in Polokwane.”

She said Malema had not yet been arrested.

“No, he hasn’t. My understanding is that he won’t be arrested.”

She said the charges against her client were unknown.

“We do not know what the charges are and we don’t have a copy of the warrant.”

A City Press report said that Malema faced charges of money laundering, corruption and fraud relating to his Ratanang Family Trust and its share holding in On-Point Engineering, a company that allegedly made millions from Limpopo government tenders.

Authorities refused to comment or confirm the warrant.

Unshaken

The SA Revenue Service said it had nothing to do with the warrant.

“…We want to state categorically that any and all reports that SARS requested that a warrant be issued for Mr Malema’s arrest are completely untrue and without foundation,” it said in a statement.

“Sars is not involved in the criminal investigation into and prosecution of this matter.”

The Hawks said it did not issue warrants.

“The Hawks don’t issue warrants, so we don’t comment on that,” said Hawks spokesman McIntosh Polela.

Asked if the unit was planning to arrest Malema, he said: “Even if we were planning to arrest him, we won’t tell you.”

Police Minister Nathi Mthethwa’s spokesperson, Zweli Mnisi, referred queries to provincial police.

Gauteng police spokesperson, Brigadier Neville Malila, said he knew nothing about an arrest warrant for Malema.

Justice department spokesperson Mthunzi Mhaga could not immediately be reached for comment.

Malema’s close colleague, suspended ANC Youth League spokesperson Floyd Shivambu could not be reached for comment.

On Tuesday, Malema told reporters in Johannesburg if he was arrested, it would be done illegally.

“If we are illegally arrested tomorrow, we would have been arrested by [President] Jacob Zuma,” Malema said at the time.

He said he was willing and ready to go to jail, and was not intimidated.

“I have nothing to hide… I only have my convictions. Nothing will stop me from fighting for economic freedom, not even my death… We are unshaken.”

Malema said he had it “on good authority” that there were instructions “to get rid of some us…”

At the time, presidential spokesperson Mac Maharaj said: “The presidency is aware that this person is prone to making wildly unsubstantiated and unwarranted claims and statements, and we do not wish to dignify them.”
