Former Municipal Manager and co-accused in court for alleged money laundering, corruption and fraud

By KEDIBONE MOLAETSI

18 March 2025- The accused, Patrick Pogisho Shikwane (53), Leslina Olga Ndlovu (45), the former Chief Financial Officer of Bojanala District Municipality, Patrick Tlhapi (53), the Bojanala District Municipality Chief Whip, Gontse Kekana (39), the Secretary to the Former Municipal Manager, and Mantsho Gloria Moremi (38), the service provider, briefly appeared in the Rustenburg Magistrate’s Court on 18 March 2025, facing charges of fraud, money laundering, corruption and contravention of the Municipal Finance Management Act 56 of 2003.

The National Prosecuting Authority (NPA) regional spokesperson in North west, Sivenathi Gunya said the accused were arrested on 17 March 2025, by the Hawks’ Serious Commercial Crime Investigation, Serious Corruption Investigation, and the Hawks’ Head Office Tactical Operations Management Section (TOMS). Gunya said their arrests follow an investigation by the Hawks’ Serious Commercial Crime Investigation into allegations of defrauding the Bojanala Platinum District Municipality of over R25 million between December 2018 and May 2019.

“It is alleged that in 2018, Ndlovu colluded with a service provider, who is still at large, to have her company, which was not on the database of the municipality’s service providers, to claim payments for services rendered to the municipality. The CFO and the service provider allegedly used details of a registered service provider to claim for payments.

“However, the payments were paid into a bank account that was not on the municipality’s database. Investigation revealed that funds, amounting to over R2 million, were transferred from the service provider’s bank account into the bank account of the CFO’s company,” he said.

He further said it was established that R150 000 was transferred from the service provider’s bank account into the personal bank account of the Chief Whip. Gunya alleged that the Secretary to the former Municipal Manager, reportedly benefitted R850 000 from the funds.

“Shikwane faces 53 counts of fraud, 53 counts of money laundering and one count of contravention of the Municipal Finance Management Act (MFMA). Ndlovu faces 53 counts of fraud, 53 counts of money laundering and five counts of corruption.

“Tlhapi faces one count of corruption, while Kekana faces two counts of corruption; and Moremi faces one count of money laundering. The matter has been postponed to 20 March 2025, for formal bail application. The arrest of two other service providers is imminent,” he said.

Meanwhile, the acting North West Provincial Head of the Directorate for Priority Crime Investigation, Brigadier Silas Munzhedzi and the Director of Public Prosecutions in North West, Dr Rachel Makhari, have applauded collaborative work between the Hawks and NPA in ensuring that the accused are brought to book.

Govt spent R3.5m to rescue illegal miners in disused Stilfontein mine

By KEDIBONE MOLAETSI

18 March 2025 – The Portfolio Committee on Minerals and Petroleum Resources together and the Portfolio Committee on Police both welcomed the presentations they received from the Department of Minerals and Petroleum Resources on derelict and ownerless mines and from the Department of Police on Operation Vala Umgodi.

With Operation Vala Umgodi coming to an end in May 2025, the committees welcomed the news that work is underway to consider possibly establishing a dedicated police unit that will specialise in illegal mining on a permanent basis. There are 6100 derelict and ownerless mines in South Africa, which are all breeding grounds for illegal mining and related criminal activities.

The Co-Chairperson of the meeting, Mikateko Mahlaule said the Department of Police’s presentation on Operation Vala Umgodi focused on the police’s successful operation at the Stilfontein mine in North West, where illegal miners were rescued by community members and the Mine Rescue Services, at a cost of R3.5 million. Mahlaule said the committees were pleased to hear that the money incurred by the state in the rescue operation will be recovered from the Buffelsfontein Gold Mine.

“Most of the rescued and arrested illegal miners at the Stilfontein operation were illegal immigrants from neighbouring countries, including 93 dead bodies that were retrieved from underground. The committees encouraged ongoing communication and coordination between the two departments to avoid giving attention to illegal mining incidents when illegal miners are already deceased.

“The committees welcomed the detailed account of events at Stilfontein, saying that the meeting provided members of the public with an opportunity to learn more about the role played by the state,” he said.

Mahlaule said a follow-up joint meeting will be convened with the portfolio committees on Home Affairs, Defence, Health, and Justice and Constitutional Development.

Northern Cape Provincial Government to commemorate Human Rights Day

By KEDIBONE MOLAETSI

18 March 2025- The North West Premier, Dr Zamani Saul will lead the commemoration of Human Rights Day in Okiep, in the Namakwa District on 21 March 2025. Saul spokesperson, Naledi Gaosekwe said Human Rights Day is commemorated under the theme: “Deepening a Culture of Social Justice and Human Rights,” which emphasises the continuous need for transformative action to ensure that human rights are not only recognised but fully realised for every individual, everywhere.

Gaosekwe further said Human Rights Month continues to remember and honour those who enabled them to achieve freedom and democracy. She added that this includes the courageous men and women who marched in Sharpeville and Langa on 21 March 1960, for the total abolition of

pass laws.

“The Sharpeville Massacre and Langa March exposed the brutality of apartheid for the whole world to see and united our people’s unyielding resolve for freedom. This year’s commemoration of Human Rights Month coincides with the 70th

anniversary of the adoption of the Freedom Charter. The Freedom Charter proclaims that, “South Africa belongs to all who live in it” and that “all shall be equal before the law”.

“It is the foundation on which our world acclaimed Constitution was drafted. As we commemorate Human Rights Month, it is important to note that Library Week is also celebrated annually from the 17 – 23 March in South Africa. An array of

programs to foster a culture of reading and encourage community members to sign up for membership at their local libraries has been planned for this week,” said Gaosekwe.

She said these programs will be held in all 5 Districts of the Northern Cape at the various community libraries and will be linked to the important role libraries play as an integral and often

underappreciated role in promoting social justice and safeguarding human rights. Gaosekwe said this year, as part of commemorating Human Rights Month, the Northern Cape Provincial Government will also honour Grace Seboto through the

unveiling of a tombstone on 20 March 2025, in Paballelo.

“Grace Seboto was one the first women of the Northern Cape, who went into exile, where she was subjected to vigorous training in order to be part of a detachment to fight for the freedom and liberation of South Africa. The very Freedom we are enjoying today,” she said.

Sharpeville Massacre victims did not die in vain

By BAKANG MOKOTO

18 March 2025- The ANC Member of Provincial Legislature (MPL), in North West Provincial Legislature (NWPL), Kgalalelo Makgokgowa on Tuesday, declared that 69 victims of the 21 March 1960 Sharpeville Massacre, did not die in vain, but died for South Africans to enjoy the freedoms they enjoy today. Makgokgowa said in their memory, they need to entrench the culture of human rights and redress inherited past imbalances that were created by white supremacists that continue to advocate for exclusion and protection of the infamous 1913 Land Act that justified land dispossession.

She further said the supporters of anti-transformation emboldened by extremists, who have no regard for multilateral institutions and human rights in South Africa, Palestine and everywhere across the globe, now have allies who have bought into their false narrative of imagined white genocide. Makgokgowa added that, the ANC, has nonetheless stayed determined to redress the past inequalities with legislation it has passed since the dawn of freedom to ensure that it overcomes institutionalised racial segregation and discrimination that still haunts the historically marginalised to this day.

“We have nonetheless stayed determined to redress the past inequalities with legislation we have passed since the dawn of Freedom to ensure that we overcome institutionalised racial segregation and discrimination that still haunts our people to this day.

“The Freedom Charter still finds expression in the ANC’s unwavering commitment towards achieving a united, non-racial, non-sexist, prosperous and a democratic society. The dignity of our people will not be restored as long as they remain landless, unemployed and without hope for the future,” she said.

Makgokgowa underscored that the ANC’s progressive policies on Gender-Based Violence (GBV) and discriminatory violence against the LGBTQ communities have been instrumental in protecting their human rights and dignities of the most vulnerable.

“We have shown our commitment to human rights by opening shelter for victims of Gender-Based Violence such as Thuthuzela and Khusela centers, offered psychological assistance through victim recovery programmes and ensured that our police stations and staff offer a victim friendly environment.

“We call on government to make the Sex Offender Register Public and see to the successful establishment of a fully functional and properly resourced National Council on Gender-Based Violence and Femicide Act, which will be a national structure to oversee a coordinated response to GBVF,” she said.

Makgokgowa said as they reflect on their journey, they reaffirm their commitment to building a South Africa, where no one is left behind. She said they must deepen the culture of human rights by holding leaders accountable, ensuring fair economic opportunities, as well as foster the spirit of social justice and ubuntu.
