A case against a 59 year-old man from Maphoitsile village, near Taung was finalized by Taung Magistrate Court on Monday.
Joseph Pebe(59) was accused of assaulting his wife who is suffering from arthritis.
The assault case with intention to do bodily harm allegedly took place last year October at the couple’s matrimonial house.
According to Akanyang Pebe(54) who uses crutches, said her husband arrived at home and demanded the herbal medicine he bought.
She said what sparked the argument which eventually precipitated to a fight was when she informed her husband that they consumed the medicine and is finished.
It is alleged that Pebe manhandled her and hit her against the wall.
Akanyang allegedly went to seek medical attention to the nearest hospital. However according to magistrate, the medical reports indicated that Akanyang Pebe suffered bruises only on her wrists and kneels which she never indicated during trial.
He said there were no valid reasons beyond reasonable doubt that could link Pebe with assault case.
Mmoloki Mkize who was the accused’s lawyer reiterates that his client isn’t not guilty because the medical reports was acquired three days after the alleged commission of crime.
“I can proudly say my client isn’t guilty because according to medical reports which was only acquired three days after the alleged crime, indicates that the complainant suffered injuries on her wrists and kneels which was not indicated by her in cross examination” Mkhize said.
Taung Magistrates Court found Pebe not guilty because they said there was no enough evidence to convict him.
Pebe who was also served with protection order by the victim was not found guilty of violating protection order’s rules.
South African Civic Organisation (Sanco) Regional Secretary in Dr Ruth Segomotsi Mompati District, Mika Moeti blasts the justice system and said it really shows that justice can be bought by money.
“We really lost hope in our justice system because it failed us. The evidence was there and now the court says the evidence was not enough. The court was supposed to take Akanyang Pebe’s level of education into consideration because she couldn’t interpret what was in the medical reports” Moeti said.
