DA seeks clarity on Info Bill

Cape Town – DA parliamentary leader Lindiwe Mazibuko has asked President Jacob Zuma for clarity on the extent to which MPs can make amendments to the protection of state information bill.

In a letter sent to Zuma this week, she wrote: “It is unclear whether you have referred only sections 42 and 45 of the bill back to Parliament or whether there are other sections of the bill, which you have constitutional reservations about.”

 

Mazibuko added: “We request that you provide clarity on this matter, so that we may begin the processing of the bill accordingly.”

 

Zuma last week said he believed the bill would not pass constitutional muster and singled out those two sections as problematic.

 

His letter to National Assembly Speaker Max Sisulu, referring the bill back to the legislature, said he was doing so “insofar as sections of the bill, in particular sections 42 and 45, lack meaning and coherence, consequently are irrational and accordingly unconstitutional”.

 

This has prompted speculation as to whether the review would be confined to those sections, or whether there was scope for further changes to a bill that has met with more sustained popular protest than any other in the post-apartheid era.

 

DA MP Dene Smuts, who was involved in the drafting process and will serve on the ad hoc committee reviewing the bill, said the president’s intentions were not clear from the letter, which posed a constitutional problem.

 

Sending the bill back

 

Zuma invoked section 79 of the Constitution when he sent the bill back to Parliament.

 

However, parliamentary joint rule 203 stated that in such an instance, the legislature could only concern itself with the sections of the bill the president referred for reconsideration.

 

“There is a constitutional problem because the president cannot send something back in vague terms,” Smuts said.

 

“We can only look at what he referred back. It is not clear what he meant and he must say what he means.”

 

Smuts and African Christian Democratic Party (SACDP) MP Steve Swart wrote to Zuma after the Assembly passed the bill in April and pointed out that section 45 had been rendered meaningless, and in their view unconstitutional, by a punctuation error.

 

The section crucially seeks to criminalise wrongful classification of information, and was seen as a hard-won safeguard against the potential abuse of the legislation to cover up state wrongdoing.

 

But the two opposition MPs argued that the omission of a full stop after a sub-clause had effectively rendered it void.

 

“The result of this drafting error is that the amendments, which would otherwise in our publicly stated view successfully have addressed the most contentious issue in this bill, namely the limitation of the rights to information and free speech, are now rendered inactive,” they said.

 

Objections

 

Activists who have fought against the passage of the bill for three years have expressed hope that the president’s letter would open the door for a comprehensive rewrite.

 

Their objections revolve around more provisions than those Zuma singled out as cause for review, notably the absence of a public interest defence in the bill.

 

This issue was singled out by veteran human rights lawyer George Bizos last week.

 

He said it remained one of several fundamental flaws in the new official secrets legislation.

 

“We want to remind people that the two sections don’t change the fact that the bill is deeply flawed,” he said.

 

The ad hoc review committee is expected to start its work next week, and has been given until 31 October to complete it.

 

Mazibuko’s office said she was still waiting for a response from the presidency.

A boy,16, stabbed for his shoes in North West

Bloemhof-North West police are investigating a case of robbery after a 16 year-old boy was badly assaulted and robbed his belongings.

Captain Pelonomi Makau said the incident took place in Bloemhof CBD whereby a teenager and his friends were allegedly watching some street performance in town when he was attacked.

 

“A 16 year-old boy was allegedly watching street performance in Bloemhof when two suspects allegedly attacked him. He was stabbed in the back with a knife by a suspect and the other one allegedly hit him with bottle of beer on his head” Makau said.

 

According to the victim, the suspects are known to him and he was allegedly taken to Bloemhof hospital bleeding profusely.

 

“Paramedics transferred him to Tshepong hospital from Bloemhof after he bled profusely” she said.

 

The suspects allegedly robbed the victim his shoes and cellphone.

 

A case of robbery and assault were opened and investigations continue.-TDN

COSAFA Off to Lesotho

The Mountain Kingdom of Lesotho has been confirmed as host nation for the 2013 COSAFA Under-20 Youth Championships that will be played from December 3-14.

The annual event is seen as key to the future development of football in the COSAFA region and this year Lesotho have been entrusted with hosting the best young talent in Southern Africa.

All Member Associations of COSAFA have been invited to the tournament and are required to confirm their participation by Friday, September 27. The draw for the championship will be held in early October in Lesotho, with the exact date to be communicated at a later stage.

“We are delighted that Lesotho has agreed to host this crucial tournament and look forward to working together with the Honourable Minister of Gender, Youth and Sport Thesele Maseribane, and the Lesotho Football Association (LEFA) to stage a world-class event,” says Suketu Patel, President of Cosafa.

“Lesotho have shown a desire to help develop the game in the COSAFA region and we have every confidence that this tournament will be a tremendous success. We would like to thank the Lesotho government for their unequivocal support.”

The tournament will be played across two venues – Maseru and Mafeteng – with a round-robin group stage featuring four pools. The top team in each group will advance to the semifinals, after which the tournament switches to a knockout format.

The COSAFA Under-20 Youth Championship has been played in various guises since 1983, with Zambia, Zimbabwe and South Africa the dominant forces in the region.

The last event to be staged was in Botswana in 2011, when Zambia pipped Angola 2-1 in the final.

A number of the region’s top stars have cut their teeth at the COSAFA Under-20 Youth Championships, which has served as an excellent stepping-stone from junior football into the professional ranks.

Ajax Cape Town winger Keagan Dolly says he was “very inspired” when he saw Thulani Serero playing for Ajax Amsterdam in the Champions League last night.

Serero, an Ajax Cape Town product, made the move to Holland after an expressive season with the Urban Warriors, as they finished second in 2010/11.

The 23-year-old was brought on at the hour mark against the Spanish giants, and earned Ajax a penalty, being brought down by a clumsy challenge from Javier Mascherano.

Roger de Sa says Orlando Pirates will give it a full go when they host Al-Ahly at Orlando Stadium on Sunday – with a match against Bayern Munich the big attraction.

A win for Bucs will guarantee a place in the semis of the CAF Champions League, and with the winners of Africa’s premium club competition getting to play in Fifa’s Club World Cup, De Sa hopes to do battle with Europe’s reigning champions.

“I certainly hope we can reach the semis. The players deserve to be in the next round because they have worked hard; we’ve been in very unfriendly places and we have managed to come through it, and I just hope we can continue,” he says.

“[The CAF Champions League] is a massive competition … there is no doubt about it. If you win the Champions League, you’ve got an opportunity to play in the World Club champs. Can you imagine Orlando Pirates v Bayern Munich? That will be a great experience for all of us.

“It will be great to measure ourselves against one of the best teams in the last decade or ever. You wanna go as high as you can. I hope we can put on a good showing on Sunday. I really hope so.”

Pirates thumped Ahly 3-0 in Cairo in the first clash between the two sides, but De Sa knows it won’t be such smooth sailing again.

“Al-Ahly have some quality players, but so do we. We must make sure we come to the party.”

It was far from pretty, but Orlando Pirates coach Roger de Sa says it was a valuable win over Polokwane City in their Premiership match at Orlando Stadium.

While Pirates were far from clinical on attack, which accounted for the 1-0 scoreline, Polokwane looked out of their depth last night against a clearly tired Buccaneers outfit.

“It was tough, when you start missing opportunities you start wondering. Fortunately we got one on target and got the three points,” said De Sa after the match.

“The most important thing was winning tonight (last night). It was crucial.”

Polokwane parted ways with coach Duncan Lechesa on Monday, and physical trainer Eduardo Schoeler took the reins for the clash.

De Sa said he had opted to rest a number of players after his side’s CAF Champions League commitments.

“It was important to make changes, as we have another game on Sunday (against Al Ahly in the CAF Champions League).

“Travelling takes a lot out of the players. Even tonight players looked lethargic. Oupa (Manyisa) didn’t look himself. Andile (Jali) also came back, there were a lot of changes but I don’t think it was a weakened team.

“Daine (Klate) was just rested, Lennox (Bacela) was another as well as Lucky (Lekgwathi).”

Following two successive losses in the African competition, De Sa was pleased to get a win under his belt regardless of the opposition.

“(Last night’s) game was very important to us. Just to get a win after the two losses. At this club, every game is important, everyone expects you to win, I certainly do.”

Meanwhile, caretaker Polokwane coach Schoeler said it was not his decision on how long he would be filling the role.

“The boardroom will decide who will coach the next game, for now I’m the caretaker,” said Schoeler.

Schoeler said he worked in first and second division sides in a stint in Brazil before coming to Polokwane to take up the physical trainer position.

Boxing CEO may be suspended

The troubled Boxing SA (BSA) chief executive will be put on suspension tomorrow, two independent sources have told City Press.

“The BSA board and the department of sport and recreation have realised that all the controversy surrounding Qithi will divert our attention from the National Boxing Indaba (NBI) and the only way was to suspend him,” said a senior source in boxing administration who spoke on condition of anonymity.

Contacted for comment, the department’s spokesperson, Paena Galane, said the BSA CEO was not suspended.

“The DG (Alec Moemi) is meeting with the chairperson of BSA today and the BSA board is meeting tomorrow to consider the Moffat Qithi matter,” added Galane.

Another source revealed that Qithi’s suspension was likely to be followed by his axing following damning allegations made against him in the South Gauteng High Court this week.
