Kimberley-Johan Jacobs (25) will spend the 22 years in jail after been found guilty and sentenced for double murder and assault with intent to cause grievous bodily harm “Assault GBH”.

John murdered his own brother and his cousin on 22 December 2012, after argument over food, on Witfontein farm.

On that fateful day during the quarrel,he drew a knife out of his pants pocket and stabbed his brother Denzel Jacobs (20) three times in the chest.

Lieutenant Olebogeng Tawana said Denzel died on the scene, while other family members tried to resuscitate him.

“After the atrocity,he left the house through the back door, and he met his cousin Maans Jacobs (18) at the door. Maans asked him what is happening and what is that he did in the house and why did he stab Denzel. He aggressively drew out knife again and stabbed Maans Jacobs in the chest two times and also died on the scene” Tawana said.

Outside the house, on his way out of the yard premises he came across Tshepiso Selogilwe, who also became Johan’s victim.

He assaulted him with the intention to cause the grievous bodily harm.

Tshepiso sustained injuries and bruises after being attacked.

The tragic of the double murder episodes changed the festive mood among the Jacobs’ family and the parents of the deceased.

“Johan appeared before the Northern Cape High Court, on Friday to learn about his fate and hoping to get lesser sentence”.

“Holding a small pocket bible in his hand while in the dock, with an anguished facial appearance, Johan expected a miracle to happen in his favour” Tawana said.

Before Judge Violet Phatshoane handed down the sentence, she indicated number of elements that the court had took into account, including the mitigating factors which his attorney had brought before the court. However she could not agree, with the proposed 15 years jail term that which was proposed by the State prosecutor.

“Your previous convictions will not incriminate you in the current case” she said.

“However the court view, these double murders is in a very serious light. The South African constitution recognises the right to life and this right is very absolute” Phatshoane said.

The court said no person has the right to take away any person’s life.

Phatshoane refuted his argument statement, which says he killed Denzel and Maans because he was defending himself against them.

She called his statement a “fabricated defence”.

The deceased were not armed, during the incident; therefore they were not posing any threat to him.

“It was clear that during this incidents you were ruthless, you should have took note that your first murder was wrong, however you continued and commit the second murder” she said.

The judge further applauded all the witnesses who took stand to testify against Johan.

“They were true to be true, they were explicit during cross examination and when they were giving testimony”.

She described Johan as a vicious, violent and aggressive person.

Both Denzel and Maans were bread winners.

“The family are unable to come to terms with their untimely death. The family had to mourn and bury their loved ones during the festive time” she said.

The accused was supposed to be role model to both the deceased because he was much older than them, she said.-TDN

ABs grab bonus-point win

La Plata – A last-minute Ben Smith try gave New Zealand a bonus-point 33-15 Rugby Championship victory over Argentina in La Plata on Saturday.

The result moves the All Blacks five points clear of South Africa at the top of the table ahead of a showdown at Ellis Park in Johannesburg next weekend.

Right-wing Smith struck for the second time in the match with just 27 seconds left, using brain and brawn to dive over and trigger celebrations.

New Zealand triumphed 54-15 at Estadio Ciudad de La Plata last season, but it was a much closer contest this time with handling errors costing Argentina dearly at times.

“It was tough out there and all credit to Argentina for pushing us so hard,” said New Zealand skipper and No 8 Kieran Read.

“We were great at times in the second half, giving us a lot of positives to build on before facing the Springboks next weekend.”

Argentina are still without a Championship victory since making their debut last year, but this performance offers hope that they can overcome fellow strugglers Australia next weekend.

“Are we ready to take on the Australians? Well, not right now,” was the humorous response of Pumas captain and No 8 Juan Martin Fernandez Lobbe to a question.

“We must rest first, then prepare to throw everything into our final game of the season against the Wallabies in search of a victory.

“New Zealand are a great team. They apply pressure all the time and when you make a mistake, they are ruthless finishers.”

Argentina had an early chance to take the lead from a long-range penalty, but centre Marcelo Bosch saw his attempt drift well left.

Los Pumas switched goal-kickers for a shorter shot soon after and fly-half Nicolas Sanchez made no mistake to nudge the home side ahead.

All Blacks playmaker Aaron Cruden, starting in place of injured Dan Carter, levelled from a penalty four minutes later.

Sanchez restored the Pumas’ advantage through another successful penalty and missed a further attempt, leaving Argentina 6-3 ahead midway through the opening half.

But once again the lead was short-lived as left-wing Julian Savea snapped up a loose ball in midfield and darted down the wing to go over in the corner.

Cruden was off target with the conversion only to be given a second chance because a spectator shone a green laser at him.

The playmaker appeared unsettled by the incident and missed his second chance as well with the ball again veering left of the near post.

Cruden did succeed with a penalty shot though, as did Sanchez, giving the 2011 Rugby World Cup winners an 11-9 lead at the break.

That changed to a one-point deficit four minutes into the second half as Bosch comfortably slotted his second 50m effort between the posts.

However, the All Blacks were never prepared to trail for long and just two minutes later Cruden kicked his third penalty of the game to reclaim a two-point lead.

New Zealand were looking increasingly dangerous on attack and flank Sam Cane and Smith crossed the try-line within five minutes to push the visitors 26-12 ahead.

Cane dived over in the corner after slick handling took the ball from one side of the field to the other, but Cruden fluffed the conversion.

Smith claimed his sixth try of the Championship by bursting through the middle after being set up by a moment of magic from veteran centre Ma’a Nonu.

Cruden converted this time before the rattled Argentines regained some composure and Sanchez kicked his fourth penalty.

With 10 minutes left it was 26-15 to the All Blacks, but they needed one more try for a bonus point and a five-point advantage over great rivals the Springboks.

It appeared to have eluded them until Smith burst through and South Africa must win with a bonus point and prevent New Zealand gaining any points to snatch the title.

SA on terror alert

Image

Pretoria – South Africa has been put on terror alert after Samantha Lewthwaite, the alleged mastermind behind the Kenya terrorist attack, was seen doing surveillance of embassies in Pretoria recently.

Dubbed the “White Widow” by the British media, Lewthwaite has been on intelligence watch lists for the past two years. Recent sightings of her were brought to the attention of the South African police intelligence by a security organisation linked to the local Jewish community.

According to the Sunday Independent, South Africa is on a level 4 – orange-coded – rating following this new development. Only a red alert is more intensive – which could lead to the evacuation of foreign diplomatic staff.

Lewthwaite had been wanted in South Africa for identity fraud and in Kenya for being in possession of illegal explosives as well as for conspiracy to commit a crime. Interpol has meanwhile issued a red notice for her arrest. This binds all 190 member countries to assist in tracking her down and arresting her. Lewthwaite was the wife of British suicide bomber Germaine Lindsay, who blew himself up along with 26 commuters in the 7 July 2007 London bombings.

Sanef welcomes media transformation report

Image

Johannesburg – A report into transformation in print and digital media was welcomed by the SA National Editors’ Forum [Sanef] on Saturday.

“As Sanef, we believe the media industry must lead change and be ahead of the curve,” it said in a statement.

“This is because we are industry-styled as a fourth estate and we enjoy constitutional protection.”

This meant that the media had a higher responsibility to be an exemplar of transformation.

On Friday the report was handed to Print and Digital Media SA (PDMSA) in Johannesburg.

The task team recommended that the annual transformation targets of each company should be made public, so that progress could be monitored and measured.

It found that print and digital media had failed to sufficiently transform in terms of ownership, management control, skills development, and employment equity, especially with reference to women and the disabled.

The industry achieved more in areas such as socio-economic development, preferential procurement, and, in certain cases, enterprise development.

Sanef said the report was the first exhaustive study of the state of transformation in the industries.

“We thank the task team led by Nkwenke Nkomo and his commissioners and managed by Mathatha Tsedu and his team at the secretariat.”

Sanef hoped PDMSA would tackle the slow rate of transformation in media ownership.

“As senior managers in our industries we will continue to do all possible to ensure transformation in the areas in which we have control such as training, hiring and promotion of editorial staff.”
