Kotze’s accountability to be disputed

Image

Pretoria – So-called “Modimolle monster” Johan Kotze would argue non-pathological incapacity in his defence, the High Court in Pretoria heard on Monday.

Despite three psychiatrists finding Kotze fit to stand trial, Piet Greyling, for Kotze, told the court he would argue this in his client’s defence.

The trial was postponed to Tuesday to allow Greyling time to get the records of court proceedings thus far.

The State closed its case on Monday on condition it could call expert witnesses to testify on Kotze’s accountability. Greyling said he would object to this.

He argued the State should call witnesses before closing its case. Acting Judge Bert Bam said the matter would be dealt with if and when it arose.

“We will cross that bridge when we get to it.”

Earlier, on Monday the court heard testimony that Kotze was not disassociated on the day of his arrest.

“He was tired and dejected,” Kotze’s doctor Louis Pienaar told the court.

“He knew who I was. I summed him up as well orientated.”

Pienaar told the court how police asked him to examine Kotze after his arrest on January 11, 2012. He said he had treated Kotze twice before.

Greyling questioned Pienaar on the possibility his client could have suffered from acute stress disorder.

Pienaar maintained Kotze appeared well orientated. He said based on his appearance Kotze did not suffer from anxiety or disassociation.

“I think it was a matter that he had reached the end of his (week on the run).”

Pienaar testified that no doctors wanted to examine Kotze the day he was arrested. He said he was not on standby that day, but was called in.

“My secretary said no other doctor was prepared to look at him.”

Pienaar testified about Kotze’s physical state when he arrived at his office.

“He was generally covered in dust. His clothes were also covered.”

There were scratches on his forearms and lower legs and bruising on his head. Kotze also said he had muscle cramps, was thirsty, and had higher than normal blood pressure.

Pienaar said the scratches appeared not to be self-inflicted. They were most likely from the thorn bushes Kotze said he was hiding in, he said.

The State’s last witness on Monday was Dr Susanna Gräbe, an expert on sexual violence. She first gave evidence in November and her cross-examination was continued on Monday.

Gräbe gave her expert opinion in the field as she did not examine the victim, Ina Bonnette. She testified that between 10 and 30 percent of rape victims did not sustain injuries to their genitals.

“In most cases rape victims have more physical injuries than genital injuries.”

Francois van As, the lawyer for two of Kotze’s co-accused, Pieta Mohlane and Frans Mphaka, asked whether Bonnette’s genital injuries could have been cause by objects other than a penis.

He was referring to Bonnette’s testimony that Kotze inserted his thumb and a pair of tongs into her. Gräbe said it was possible but not definitive.

“It is not excluded that there could have been penetration or penetration with an instrument.”

Kotze, Andries Sithole, Mohlane, and Mphaka are accused of murdering Kotze’s 19-year-old stepson Conrad Bonnette at Kotze’s house in Modimolle on January 3.

They are also accused of kidnapping, assaulting, repeatedly raping, and attempting to murder Ina Bonnette earlier that day.

A plea of not guilty was noted on Kotze’s behalf after he refused to enter a plea, and claimed his accountability and ability to follow and contribute to court proceedings were in question.

His three co-accused all pleaded not guilty to the charges. They claimed Kotze forced them to take part in the attack on Bonnette and said they had only pretended to rape her.

Bonnette testified Kotze tortured her with various objects before instructing the other three to rape her. She told the court she listened to her son pleading for his life before he was shot in the head and heart. – Sapa

Retailers implicated in meat scandal to be sanctioned

Image

The Red Meat Industry Forum (RMIF) says it will press ahead with its investigation into the meat scandal which could result in prosecutions. The RMIF earlier said it was premature to release the names of the retailers implicated in the meat contamination study.

Professor Louw Hoffman headed up a team of researchers from Stellenbosch University that had found traces of chicken, donkey, water buffalo and goat meat as well as soya in incorrectly labelled products.

The names of the retailers were supposed to remain confidential. RMIF Chairperson Dave Ford says, “If there are perpetrators, let the relevant authorities do an investigation and then let them follow their legislation, and if there is sufficient legislation and then to either prosecute or to remove the blame from this different individuals or these different retailers.”

“We feel that at this specific stage just to name and shame a number of retailers whether it could be cross-contamination is very premature, but we’re still going ahead from the forum side, supply this information to the relevant authorities as well as to the national consumer commission.”

Woolworths says they blame shared equipment for the contamination

Meanwhile, Woolworths says they blame shared equipment for the contamination. Woolworths Food Technologist Karen Carstensen says out of all the products tested, they only found their french polony to contain traces of chicken DNA that was not labelled.

A number of various meat industries were earlier in the year found to have labelled their red meat incorrectly, with traces of water buffalo, donkey and goat meat found in processed meat.

ANCYL hails female duo

227006826

Messages of support poured in from different youth political groups in the province to congratulate the provinces duo of Bongiwe Mbinqo-Gigaba and Maropene Ntuli in their appointment in the ANC Youth League’s national task team (NTT).

The team will be headed by Mzwandile Masina as convener and Magasela Mzobe as the coordinator.

The ANCYL provincial secretary, Dikgang Stock, said they were happy with the inclusion of Ntuli and Mbinqo-Gigaba.

“When we received the news we immediately called them and wished them well. I told them that they are faced with a daunting task to unify the youth league,” he said.

Stock indicated that the province would assist and support Mbinqo-Gigaba and Ntuli in their new deployment. “They clearly need our support and we cannot deny them that. The President (Jacob Zuma) has called for unity in the organisation and we are working towards that, to unify our people and our structures. The NTT will therefore need our support in this regard.”

The provincial secretary of the Young Communist League, Kabelo Mohibidu, also congratulated them.

“We were in fact, forming part of the process of appointing the two. We endorsed their names and gave input to the SG (secretary-general) on why we think they can take the league forward. We are glad that the ANC listened to us.”

Mohibidu referred to Mbinqo-Gigaba and Ntuli as “young female activists who will revive the youth league moving”.

ANCYL provincial chairperson, Shadrack Tlhaole, joined the chorus of congratulations and hailed Ntuli and Mbinqo-Gigaba as outstanding leaders.

Don’t put corruption on ice, says Vavi

Vavi

Cosatu general secretary Zwelinzima Vavi warned workers at the provincial shop stewards council in Galeshewe, Kimberley, on Saturday that corruption in government will lead to the ANC losing votes in the upcoming election.

He said corruption is not only rampant in government “but also in the unions”.

“We have corrupt individuals, who if not confronted head-on, they will kill this organisation,” he said.

“Don’t put corruption on ice. Corruption is corruption, no-matter who is involved. Whether it is Mandela or Zwelinzima Vavi, when they are corrupt expose them,” he said to loud cheers.

He spoke frankly about recent media reports that Cosatu was investigating him, after he allegedly sold the federation building at a non-market related price of R10m.

“There is process in the federation to check if there is truth in all these allegations. Once allegations against everyone are made, there must be processes to check if those allegations are true.

“No matter how important you think you are, you must submit yourself to be scrutinised.

“If anyone can produce any evidence that can prove the allegations that I have stolen money from the purchase of the building. If that person can produce that evidence, the day that happens, I will walk away. I will have betrayed the workers,” he said.

Vavi also took a swipe at the “rampant corruption” which he said was common in the Northern Cape.

“In your province you go to court every day, not saying that anyone is guilty but the perception that we are corrupt will hold us in the country’s elections next year,” he said in Xhosa.

He said the country was still very far away from reaching its service delivery promises. “I doubt if we will be able to reach it in our life time.”

Vavi said Cosatu preferred an ANC that would give a better life to all.

“We want the ANC to appreciate the pressure from the ground. People want better life now, not tomorrow.”

Vavi urged the workers to support the ANC prepare for the general elections next year.
