Other info bill ‘not an attack on media’

The less-talked-about information bill – the Protection of Personal Information Bill – is not another attack on mainstream media, ANC and opposition MPs have assured, but will instead crack down on direct marketing companies.

On Tuesday, the portfolio committee on justice and constitutional development discussed the bill, which had been before Parliament the longest out of those yet to be finalised.

Its main intention is to reinforce Section 14 of the constitution, which grants everyone the right to privacy. Now in its seventh draft, the bill is expected to be made into law before the end of this year. It aims to “promote the protection of personal information processed by public and private – bodies” and to introduce information protection and establish minimum requirements for the processing of personal information. The bill also makes provision for a regulator to provide for the issuing of codes of conduct to cover the handling of personal information.

ANC MP John Jefferies and his DA counterpart, Dene Smuts, defended the bill following concerns that journalism would be a victim of the legislation, because it also dealt with the gathering and dissemination of individuals’ information without their consent.

Unity in the ANC is paramount, irrespective of who is elected to lead the party later this year, Human Settlements Minister Tokyo Sexwale has said.

ANC members who wanted to “pursue victory” at the party’s national conference in Mangaung in December should also consider what such a victory could cost a party watched closely by an electorate that should not be taken for granted, he said in giving a lecture on Nelson Mandela at UCT on Tuesday night.

The event was arranged by the ANC Youth League as part of the ANC’s centenary celebrations.

Sexwale lamented the divisions in the ANC.

No special treatment for race killer

iol news pic skierlik johan nel

Limpopo – The man jailed for killing four people in Skierlik informal settlement in North West was not receiving special treatment in prison, an official said on Tuesday.

“Johan Nel was transferred to a maximum correctional centre in Limpopo, No special treatment was given to Nel,” said correctional services spokeswoman Sarie Peens.

She was responding to an accusation by the Congress of SA Trade Union (Cosatu) North West that Nel was being given preferential treatment.

Nel is serving four life sentences for the 2008 murder of four black people in Skierlik informal settlement, near Swartruggens.

He shot dead Sivuyile Peyi, 37, Annah Moiphitlhi, 31, Elizabeth Moiphitlhi, three-months-old, and Tshepo Motshelanoka, 10. He wounded eight others.

“We are told that the racial killer (Johan Nel) is being specially treated by the correctional services to the extent that he is visited by his wife almost every day, while the African black prisoners are visited at the times programmed by the management,” Cosatu alleged.

Peens said Nel was initially held at the juvenile centre, where inmates had access to a library.

He was transferred to the Katuma Sinthumule maximum prison in Venda, Limpopo, soon after his marriage at the Rustenburg prison in February.

“He is no longer in the juvenile section,” she said.

Peens confirmed that Nel got married while in prison.

“The fact that he got married inside a correctional facility was done according to the department of correctional services policy.

“The couple received guidance from a social worker from the department of correctional services before they got married, and several media published the story about his marriage.”

She said the parents of the couple were given permission to attend the wedding ceremony inside the prison. – Sapa

Kagiso, West Rand – Fifteen people were arrested on Tuesday for public violence in a protest in Kagiso, on the West Rand, Gauteng police said.

They were arrested after police dispersed protesters, but they returned and started barricading roads, Warrant Officer Solly Sibiya said.

“They were throwing stones at the police after the situation calmed down.”

Earlier, one person was shot and wounded and two others were injured when a protest turned violent. The protests started on Monday afternoon when two children were knocked down by a truck on Tudor Road. One of them died.

Protesters pelted vehicles with stones on Tuesday. Two police officers were injured, and a protester was wounded.

“Our members were treated on the scene, and the wounded protester was taken to hospital.”

Parts of the municipal building were set alight. Roads leading into the township, and to the Chamdor industrial area, were blockaded. Firefighters were attacked when they arrived. Police had to use rubber bullets and teargas to protect them.

Earlier, residents refused to listen when Mogale City municipality officials tried to speak to them. They wanted mayor Koketso Calvin Seerane to speak to them. The residents said they had previously asked the municipality to construct speed bumps on the road, but that nothing was done, Sibiya said.

Sibiya said the police would keep a close watch throughout the night.

Dewani needs another year, court hears

Copy of CA_dewani0

London – Honeymoon murder accused Shrien Dewani needs a year to recover from depression before facing extradition proceedings, a British court heard on Tuesday.

His lawyer Clare Montgomery told the Westminster Magistrate’s Court that the process had been hanging over her client like “the sword of Damocles” and he needed “a period of calm”, reported the British Press Association.

Dewani, 32, stands accused of plotting his wife Anni’s murder in Cape Town in November 2010.

He is being treated for depression and post-traumatic stress disorder (PTSD).

Chief Magistrate Howard Riddle adjourned the hearing to September 18 for a psychiatrist, employed by the South African government, to examine Dewani and give the court more information about his condition before making any other decision.

Montgomery said keeping Dewani under medical treatment in Britain for 12 months would speed up his recovery rather than jeopardise it by sending him to South Africa.

According to his psychiatrist, he was making a slow recovery, but one damaging factor was his “constant awareness of the court proceedings”, said Montgomery.
